Now that the papers have finally revealed the names of the officers involved in the K-Mart shooting we can begin to talk about some of the details.
It turns out that the shoplifting suspect first set off two shots as he struggled to obtain Officer Gutierrez’ weapon. One of them hit Gutierrez in the shoulder, and the other hit Officer Green’s hand. In all only two bullets came from Gutierrez’ gun.
In a panic, and now hit in the hand, Green immediately returned fire, with Gutierrez getting three one additional suspected bullet hit from his partner’s gun (as determined at this time along in the investigation), along with bullet shrapnel that bounced off the floor and into the suspect’s leg and Gutierrez too. One bullet hit his radio as he was calling for help, which prevented further injury. Reports are that the wounded Green then ran away and took cover instead of helping out his partner, and that he fired 8 shots in all. Most of the total shots fired came from Green, so you can imagine where Gutierrez’ other hits came from, although it’s not official as yet.
As can be imagined, this unfortunate story is giving some good amount of aid and comfort to the BPOA’s critics, as Green was once on the governing board there and was originally recruited into the force by fellow BPOA hotshots.
None of this information is a secret now, as BPD rank and file have been told of these developments at their roll calls. And it’s the second time in four months that BPD officers have been shooting wildly at suspects in a public place.

This was not caused by Officer Green. This was caused by a criminal with a plan. There is not a cop on the planet who has not exposed himself in some way to a criminal. Fortunately, crooks dont always recognize or sieze the opportunity. Officer Green reacted to a sutiation he was thrust into.
You state that Green, wounded, returned fire and then ran away to seek cover. You are attempting to paint a picture that is grossly misleading. He summonsed aid.
At some point in time, in every fight, an officer realizes that additaional cops are needed. This is especially true if the officer is severly injured. Help needed to be summonsed and Green did that. What do you suggest, Officer Gutierrez disengauge and go get help?
The community of Burbank is lucky to not be buring two cops today. Once the crap hit the fan, it was the result of both of their efforts and will to survive that allowed them to return home to thier families.

I love the way that the BPOA Boys can never do any wrong. It is a good thing none of the Portos cops were at this shooting or the BPOA would call for a public hanging.
At first I tried to give this officer Green the benefit of the doubt, but if he shot his partner and he still didn’t hit the suspect after eight times…that is not good no matter how you look at it. Larry Nichols and “Doc” Wolfer won’t approve.
I bet the BPOA would be defending their boy even if he had killed his own partner…I am pretty sure the idea is to save your partners life, not take it to save your own.
It is a good thing that you, omar, were not investigating it. We would never be able to get a conviction that stands the appeal process because you would be interviewing suspects with your gun in their mouth.
Ill ask you again…How does it feel to know you are responsible for Neil’s death? Do you feel like a big man now. You destroyed one man and family and now you are like a serial killer…you want to see how many more you can destroy?
Read my post to you (charles11) on the K-mart shooting entry. Be careful when you finally get put in county or prison. If VBS figures out who you are you are going to be in big trouble. You know they are in county, state and federal, so there is really no safe place for you.
I am sure they remember all those mean things you said about them and their wives. I bet they remember all the mean things you did to them. I hope you start working out and learning to sleep with one eye open!

Place the blame on everyone but the bad guy. Non of this was intentional, expept for the crooks actions. God was on their side and no one was killed.

Anyway, I think its time for the new chief to look into the comments made by this lunatic officer. No wonder the department has so many problems. Call Dr. Blum…someone needs a psych eval!

Mr. Payne. I know a little bit about suicide. I’ve been touched by it twice. No matter what, no one else is responsible for the death of a person who committed suicide aside from the person him/herself who decides to end it. The key to heading off such actions is to try to seek help but in a lot cases people simply can’t bring themselves to do it and slowly get more and more isolated. People typically do not commit suicide on the spur of the moment. They think about it a long time and eventually make a plan and then follow through. The act of ending one’s own life is a tragedy but I reiterate that the individual is still the responsible party. Officer Gunn, like every police officer, lived with an exceptionally high level of stress and that should of been properly monitored. With the utmost respect to Officer Gunn’s family, no one else killed officer Gunn except himself. Profoundly sad.

It’s funny how TP defends his boys. But when the Mc Donalds incident happened last year, his boy Det. Allen failed to file appropriate charges on a man who tried to kill 2 officers because of who they were.
Here is a brief of that incident. Mofford (who reported incidents to the FBI) and Guillen (who filed a law suit against the city) were dispatched to a man with a gun at Mc Donalds. Mofford arrives first and confronts the man. The suspect grabs Moffords gun and fires off a round inside the restaurant with Moffords gun. A civilian intervenes in the fight to help Mofford. Guillen arrives as the suspect is running out, the suspect jumps in the driver seat of the patrol car, pins her in and he goes for her gun also as he is beating her face in and trying to steal the patrol car. Mofford arrives to help Guillen and the suspect flees again. Guillen tases him for a second time. And the suspect is arrested with in minutes.
To those wondering the suspect only served 3 mo in jail. That was a clear example of the divide with in the walls of BPD.
This sounds like one officer had gotten his gun back from the thief and the other officer just went on a wild shooting spree. Why would he fire any shots once the thif is not shooting a gun anymore. Honestly this is sounding like a tragic scene from Saturday Night Live and not good police work.

Why that Mcdonld’s guy did not get a stiffer sentence bothers me. Andrew points out that Allen was the handling detective. Does he file the charges? Or is it the District Attorney. Something does not sound right.
So the move of Officer Gutierrez getting his gun taken from a handcuffed suspect, and Green being shot by the suspect with Gutierrez’s gun is a minor oversight, and you’re just reporting the “facts”? Both men deserve training and equal blame for the mistakes they made. But ultimately it’s the savage behavior of the suspect that caused the incident.
Gutierrez, needs to buy a back-up gun and the BPD, LAPD, GPD LASD, PPD SMPD and all PD’s need to train with simunitions, so they react according to their training. Right now, hands on realistic training for most police department training is at an all time low. So some of the blame here goes to the Police Management training more in hugging tactics than officer survival. Shame on the BPD management. Again!
